These Terms and Conditions (“Terms”) govern your access to and use of the website and services offered by Chalk 1 Munitions, LLC (“Chalk 1,” “we,” “our,” or “us”) through our site hosted on the Gunly platform (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, do not use the Site.

1. Eligibility

This Site is intended only for individuals 21 years of age or older. By using the Site, you represent that you are at least 21 and are not prohibited by any federal, state, or local law from possessing firearms or ammunition.

2. Federal Age Requirements

Purchasing Ammunition

• 18 years or older – Required to purchase shotguns, rifles, and their ammunition.

• 21 years or older – Required to purchase handguns, all other firearms, and their ammunition.
  Federal licensees must observe these age limits even if state or local laws set lower thresholds; if a stricter local age applies, that stricter age governs.

Purchasing Firearms

• 21 years or older – Required to purchase handguns or shotguns with pistol grips.

• 18 years or older – Required to purchase rifles or standard shotguns (without a pistol grip).

3. Federal Ammunition Excise Tax

As an ammunition manufacturer, Chalk 1 Munitions, LLC is legally required to collect and remit the Federal Ammunition Excise Tax on all direct-to-consumer ammunition sales.

4. Account Registration

You may need an account to access certain features. You agree to provide accurate, current, and complete information, keep your credentials secure, and promptly update any changes. You are responsible for all activity conducted through your account.

5. Compliance With Laws

You are solely responsible for knowing and obeying all federal, state, and local laws governing the purchase, possession, and use of ammunition and firearms. Orders that violate any applicable law will be refused or canceled.

6. Orders and Payment

All prices and product descriptions are subject to change without notice. Placing an order constitutes an offer to purchase; acceptance occurs when we send a confirmation email. We may cancel or limit quantities at our discretion. You authorize us (through our payment processor) to charge the payment method you provide for the full amount due, including taxes, excise tax, and shipping.

7. Federal Firearm Purchase & Shipping Requirements

Federal law prohibits Chalk 1 Munitions, LLC from shipping firearms directly to individuals in another state. Firearms must be shipped to a Federal Firearms License (FFL) dealer near you.

How to Complete a Firearm Purchase

1. Order Online – Use our secure checkout. If known, enter your chosen FFL dealer’s name in the “Ship To” field.

2. Find an FFL Dealer – Most sporting-goods stores, pawn shops, shooting ranges, and gun clubs offer transfers (typically around $25). Confirm with your dealer before ordering.

3. Dealer License Submission – Your dealer must email us a signed copy of their FFL.

4. Shipment Confirmation – We email you when the firearm ships and provide a tracking number.

5. Final Sale Policy – Once you pick up the firearm from your FFL dealer, the sale is final.

8. Shipping Restrictions

• California Shipments – We do not ship firearms or ammunition to California. Optics and accessories may still be shipped.

• Risk of Loss – Risk transfers to you when the carrier accepts the shipment. You are responsible for any additional fees, permits, or paperwork required by your jurisdiction.

9. Returns and Cancellations

All sales are final unless otherwise stated in a product listing or required by law. If we approve a return, items must be unopened, in original condition, and returned within the timeframe stated in the return authorization. Shipping costs are non-refundable.

10. Intellectual Property

All content on the Site—text, graphics, logos, images, and software—is owned or licensed by Chalk 1 and protected by intellectual-property laws. You may view, print, or download content for personal, non-commercial use only. Any other use requires our prior written consent.

11. User Content

If you submit reviews or other content (“User Content”), you grant Chalk 1 a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, and display that content. You may not post unlawful, defamatory, infringing, obscene, or otherwise objectionable content. We may remove or edit User Content at our discretion.

12. Prohibited Conduct

You agree not to:

• Violate any law or regulation related to firearms or ammunition.

• Misrepresent your age, identity, or eligibility.

• Interfere with Site security or functionality.

• Use automated means (bots, scrapers) without permission.

• Upload viruses or malicious code.

• Infringe intellectual-property or privacy rights.

• Harass, threaten, or harm others.

13. Safety Warnings

General Firearm & Ammunition Safety

• Use only high-quality ammunition in firearms chambered for the specific cartridge.

• Inspect the barrel for obstructions if you experience light recoil or an unusual sound.

• Wear proper eye and ear protection.

• If a round fails to fire, keep the muzzle pointed in a safe direction while unloading.

• Avoid shooting at hard surfaces or water to prevent ricochets.

• Store ammunition in a cool, dry place away from heat or moisture.

• Do not reload components from fired ammunition; we disclaim liability for modifications.

• Never handle firearms under the influence of drugs or alcohol.

• Ensure proper twist rates to prevent bullet instability; a misaligned or undersized suppressor may cause baffle or bullet contact.

• We disclaim liability for use of our ammunition in suppressed firearms.

• KEEP OUT OF REACH OF CHILDREN.

Lead Exposure Warning
Shooting firearms, cleaning guns, or handling ammunition may expose you to lead, which is known to cause cancer, birth defects, and other reproductive harm. Always:

• Use firearms in well-ventilated areas.

• Wear protective gloves when handling ammunition.

• Wash hands thoroughly after exposure.

14. Disclaimer of Warranties

The Site and all products and services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure.

15. Limitation of Liability

To the fullest extent permitted by law, Chalk 1 and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use arising out of or related to your use of the Site or purchase of products. Our total liability will not exceed the amount you paid for the product giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless Chalk 1, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of or relating to your breach of these Terms or misuse of the Site or products.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any conduct we believe violates these Terms or is otherwise harmful.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Brevard County, Florida, and you consent to their jurisdiction.

19. Changes to These Terms

We may update these Terms at any time. Changes will appear on this page with a revised “Effective Date.” Continued use of the Site after changes are posted constitutes acceptance.

20. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chalk 1 regarding the Site and supersede all prior or contemporaneous understandings.
